harry reid had a chance to go for a more full-throated filibuster. but his reasoning was that when the democrats are in the majority -- in the minority and that could happen, this next election, that they want to have that same leverage that republicans have been using with this filibuster reform to block many of the president's actions. but this is a real surprise that hagel has essentially been filibusterd. it looks like ult mimately, he will be confirmed. they have been pretty successful in forcing the president's hand to release more information on that. but, ultimately, i think they are giving away some of their standing. they're supposed to be the party of national security, the party of defense in this way by blocking this very important post. i think they're doing some damage -- >> yeah, we're talking about secretary of defense. we're talking about who's going to head the pentagon. and let me tell you this, ryan, tell you how blatantly inconsistent and unprecedented this is. he said in 2005 that presidential nominees shouldn't be filibustered

reid's job and harry reid and his lieutenants obviously schumer and durbin, are supposed to get that budget done. it's shameful and really should be doing it. they say they're going to do it this time, i wouldn't hold your breath. how do you run a business and your own household if you don't have a budget. how to you set the priorities of senate and congress it's unacceptable. >> you've been at state of the union addresses and you have experience at that level of government. what are the things that if people knew about the senate, what would you want to tell them, that most surprise you in terms of its dysfunction? >> well, the biggest thing that people needed to understand that there's one person and that's the majority leader, harry reid that controls everything, and the scheduling, with a bills are brought up and when he brings up a bill, for example, when he brought up the dream act. he brought it up. we're going to pass it tomorrow. take it or leave it, no amendments, nothing, shuts off the debate and tries to ram things through and spot people over those votes or lack thereof.

where it will get sticky is once the committee sends it to the full senate and harry reid just a couple of minutes ago said he'd like to take the vote this week but the republican leader says it is possible there could be some delays to give opportunity for more information. sort of a slow walking. it's not a filibuster threat just yet. it's unclear how it will go. they don't want to show their hand but some of the resistance of republicans is they don't feel that chuck hagel explained enough about the financial arrangements since he left the senate, concerns about his views, concerns about the performance at his nomination hearing where he had some, you know, rough back and forth that we all watched. so the white house has told us that they believe the numbers are there for hagel to get the job at the pentagon. but there are a couple of steps that need to go forward, a critical one this afternoon likely to pass the committee. the rest of the story on hagel unfolding in a few days but we don't know what republicans will do. >> all right. kelly, thank you very much. we'll bring the audie

you know, the story of the last two years is that, you know, john boehner, harry reid, barack obama and so on always find some way to pull a deal out of the fire. so it would be silly to bet against that. but i do agree with charles. it's harder in this case to see -- i think you can draw it up on paper, but it's harder to see where the parties come together. i think the reasonable thing to do would be to say let's cut the amount of spending that we're going to cut in half, and let's just agree on, say, doing a little means testing to medicare, which the white house and republicans are both in favor of. and let's not get so focused on absolute dollar figures. but i'm pretty sure that's not going to happen. >> well, the clock's ticking. we'll follow it. gloria, appreciate it. charles and ross as well. >>> up next, the desperate search for family lost at sea off the coast of san francisco. and later, a murder trial that is making the casey anthony saga look, well, boring. it's got x-rated evidence, too many lies to count, plus a defendant, well, who won a singing contest from prison. the
